Preamble
The Conservatoire national supérieur de musique et de danse de Paris (CNSMDP) is a French public institution for the transmission of musical and choreographic arts. The CNSMDP organises concerts, dance performances, lectures, courses and symposia in its own and partner establishments.
The CNSMDP publishes the present site offering for sale videograms, phonograms, conference publications and other cultural products, produced and published on behalf of the CNSMDP and/or its partners.
Any order placed on the site www.conservatoiredeparis.fr (hereinafter referred to as the "Site") of the CNSMDP, will be governed exclusively by these general conditions of sale.
Article 1: Acceptance of the general terms and conditions of sale
The purpose of these general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions") is to define the rights and obligations of the CNSMPD and any non-trading individual in the context of a distance sale of products offered on the Site.
The products for sale on the Site are intended exclusively for private use within the "family circle". Consequently, any person placing an order on the Site expressly declares that he or she is not a trader or professional operator and is not acquiring the products for commercial use or for any public use whatsoever, or in general in order to derive any direct or indirect benefit whatsoever.
Any person placing an order on the Site declares and guarantees that he/she has full legal capacity to use this online sales service. Any validation of an order is preceded by acceptance of the General Terms and Conditions on the Site (checkbox).
The CNSMDP reserves the right to adapt or modify the General Conditions at any time. In the event of modification, the General Terms and Conditions in force on the day the order is placed, as published on the Site, will apply to each order.

Article 3: Product offer and availability
Product offers are valid as long as they are visible on the Site.
Items are offered while stocks last.
In the event of product unavailability after your order has been placed, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made, as the debit will only occur when the product is dispatched.
Article 4 : Product price and order amount
4.1. Product sale price
Product sale prices are those displayed on the Site at the time of purchase by the customer.
These sales prices are indicated in Euros, inclusive of VAT and other taxes, in particular tax on videograms, eco-tax, etc. at the rate applicable on the day of the order, and exclusive of shipping and handling costs.
Any change in the rate of the taxes in force or any new tax will be automatically reflected in the sale price of the products.
Please note: For deliveries outside the European Union and DROM-COM-POM, the price will be calculated exclusive of tax, and the customer will be required to pay customs duties and other taxes due for the import of products into the territory of delivery. These duties and taxes are the sole and entire responsibility of the customer, both in terms of declarations and payments to the competent local authorities in the customer's place of residence.
4.2 Total amount of the order
The total amount of the order is the definitive price in euros, including all taxes, processing and delivery charges. It is stated in the order confirmation e-mail.
Validation of the order implies unreserved acceptance of these terms and conditions of sale.
You will receive an order confirmation e-mail once your payment has been approved. Payment approval times vary according to the method of payment. The CNSMDP cannot be held responsible for any delay in the approval of your payment.
Article 5 : Placing an order
The online ordering procedure comprises the following steps:
Step 1: Selection of product(s)
For each product, a detailed description of the selected product (dimensions, photograph) and the selling price appear.
Step 2: Customer account creation/login
In order to place an order, you must create or log in to your customer account using an e-mail address and password.
To create a customer account, you must provide us with the information we need to process your order: first and last name, delivery and/or billing address, telephone number and e-mail address.
Step 3: Delivery methods and costs
The information you have provided is displayed, along with the possible delivery methods and corresponding charges. Once you have checked that all the information is correct (contact details, delivery address, etc.), you can choose the delivery method.
Step 4: Validating the order summary
The order summary is displayed on the "Order summary" page. Please check the details of your order and correct any errors before entering your bank details.
Once you have read and accepted our General Terms and Conditions, you can confirm your order.
Step 5: Payment
Online payment is made exclusively by credit card.
On-line payment of the order is made by providing your bank details (card number, validity date and visual cryptogram) and clicking on "CONFIRM".
In the event of refusal of payment by the bank concerned, the order is automatically cancelled.
Any payment made on the Site constitutes irrevocable acceptance of the order, which may only be challenged in the case provided for in articles 6 ("Right of withdrawal"), 8 ("Delivery times") and 9 ("Legal guarantees") of these General Terms and Conditions.
Step 6: Order confirmation
Once payment has been made, you will receive an e-mail confirming your order. Once confirmed, the order cannot be cancelled, except in the event of withdrawal or force majeure. This e-mail constitutes proof of your order. We recommend that you keep it.
Article 6 : Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, you have a period of fourteen working days to exercise your legal right of withdrawal and return, at your expense, the product(s) of your order which do not suit you, for any reason whatsoever, under the conditions defined in the present article 6.
Once this period has elapsed, any order placed on the Site may not be reimbursed, except in the cases exhaustively provided for in articles 8 and 9 (legal warranties of conformity and against hidden defects resulting from a defect in material, design or manufacture affecting the product and rendering it unfit for use).
6.1 How to exercise the legal right of withdrawal
To exercise your right to withdraw from all or part of the order, simply notify us of your request for withdrawal within 14 working days from the date on which you or a third party designated by you (other than the carrier) receives the product(s) covered by the order (or the last product delivered, if the order covers several products delivered separately).
You can notify us of your withdrawal by e-mail(editionsduconservatoire@cnsmdp.fr) or by post to Customer Services, specifying the following details:
- Order number
- The date of receipt of the order
- The product(s) you wish to cancel
- Your surname, first name and postal address
- Your e-mail address
You have 14 working days from delivery to exchange or be reimbursed for items returned in good condition and unsealed in the case of audio or video recordings.

If you have any questions about how to exercise your right of withdrawal, please contact Customer Services using the contact details specified in article 2 of these General Terms and Conditions.
The parcel must be returned by post only, in its original packaging, in perfect condition, unsealed (particularly audio and video recordings) and accompanied by a copy of the corresponding order confirmation.
The returned product will be reimbursed within 14 days of the date on which the right of withdrawal was exercised.
Items damaged or soiled by the customer cannot be returned.
Reimbursement will be made by the same means of payment used for the order (unless you expressly agree to reimbursement by another means of payment). The date of reimbursement may be deferred until recovery of the product or until you have provided proof of shipment of the product by e-mail or post to the address specified in article 2 of the General Terms and Conditions, whichever comes first.
Please note:
- You are responsible for the cost of returning the product(s).
- When the withdrawal concerns only part of the order (several products purchased as part of the same order) and delivery costs depend on the number of products ordered (for example, costs vary according to the price of the order), delivery costs are refunded in proportion to the products returned.
6.2 Commitment to quality
Should an item be defective due to the fault of the CNSMDP, we undertake to exchange or refund it within 14 days of the date on which the defective product is received back by the CNSMDP, subject to compliance with the following conditions:
(I) returned in its original packaging, in perfect condition,
(II) accompanied by a reasoned request and order confirmation.
6.3 Waiver of right of withdrawal
In accordance with the provisions of article L221-28 - 9° of the French Consumer Code, as an exception to the above provisions, the right of withdrawal cannot be exercised in the event that the audio or video recordings have been unsealed by the Customer after delivery.
Article 7 : Payment and order data
7.1. Payment methods
Payment for orders is made via the Site by credit card.
The following cards are accepted: CARTE BLEUE / VISA / MASTERCARD.
Payment is made exclusively in euros.
7.2. Payment transactions
You guarantee that you have the necessary authorizations to use the chosen method of payment.
Payment is made online; the customer must enter his or her card number, the date of validity and the visual cryptogram in the area provided for this purpose (SSL-secured entry).
In the event of refusal of the card used by the payment center, the order is automatically cancelled.
You are invited to print out the proof of transaction, which will appear on the screen once the order has been paid for.
7.3. Order data and purchase history
Your Customer Account contains your purchase history and order information.
7.4. Secure payment
We do everything in our power to ensure the confidentiality and security of the bank details you transmit to us via the Site.
The Site uses Paybox, a secure online payment system, which uses SSL (Secure Socket Layers) to encrypt information as it is transferred between your computer and the payment server. The Verifone/Paybox payment platform is PCI/DSS (Payment Card Industry/ Data Security Standard) certified by VISA, CARTE BLEUE and MasterCard. This certification specifies the application of the most stringent security rules to protect cardholder data transmitted during payment transactions.
Article 8 : Delivery
Products ordered are delivered under the following conditions:
8.1 Delivery times
Delivery times vary according to the product(s) concerned, the formula chosen and the destination of the order.
We remind you that, except on public holidays, delivery times begin :
- the next day for orders placed from Monday morning to Thursday evening.
- the following Monday for orders placed from Friday morning to Sunday evening.
8.2 Delivery charges
Delivery charges vary according to the product(s) concerned, the delivery option chosen and the delivery zone.
These amounts are indicated at the time the order is placed (see article 5 of these GCS).
You may therefore be required to pay several delivery charges for the same order, depending on the type of product ordered.
8.3 Order tracking and receipt
You will be informed of the dispatch of your order by e-mail.
You undertake to receive the products ordered at the delivery address shown on the order confirmation email.
You must date and sign the delivery note presented by the carrier. This dated and signed delivery note constitutes proof of transport and delivery.
8.4 Late delivery
In the event of a delay in shipment, we will send you an e-mail informing you of the new delivery date. In the event of late delivery, we will propose a new delivery date by e-mail.
You may either accept this new delivery date, or cancel the sales contract in accordance with Article L 216-2 of the French Consumer Code, and obtain a full refund of the sums paid. If you receive the product after the contract has been cancelled, the product and the cost of returning it to us will be reimbursed in accordance with Article L. 216-3 of the French Consumer Code.
Article 9 : Legal warranties
In accordance with legal provisions, the products delivered benefit from the guarantee of conformity and the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the product and rendering it unfit for use.
In order to assert these rights, you must under penalty of forfeiture of any action relating thereto:
1. Inform our Customer Service Department (whose contact details are given in article 2 of the General Terms and Conditions) in writing of the existence of the non-conformity of the product delivered or of the hidden defect affecting the product within a short time of its discovery.
2. Return the product concerned to the following address:

No product may be exchanged or refunded without our agreement and before being returned to Customer Service.
Products must be returned to us with all components in packaging suitable for transport.
Please note: In the event of an error on our part regarding your order, a defective item or an item damaged in transit, please contact our Customer Service Department, who will send you a postal label for returning the item.
Please note that :
> When you act under the legal warranty of conformity, you :
- Have two years from delivery of the product to take action;
- Can choose between repair or replacement (if the product is still available for sale) of the product concerned, subject to the cost conditions set out in article L. 217-9 of the French Consumer Code;
- Can have the sale rescinded or the price reduced (partial reimbursement of the product) if the defect is major and the chosen solution takes longer than 1 month from the date of the request, or if no other solution is feasible.
- You are exempt from proving the existence of a product's lack of conformity during the 24 months following delivery.
> Under the legal warranty against hidden defects, you :
- Have a period of 2 years from the discovery of the defect to invoke the legal warranty against hidden defects in the product sold, as defined in article 1641 of the French Civil Code.
- Have the choice between rescinding the sale (taking back the product and refunding in full) or obtaining a price reduction (partial refund of the product) in accordance with article 1644 of the French Civil Code.
Please note:
- Any legal guarantee of conformity is excluded if you were aware of the lack of conformity or could not have been unaware of it at the time of contracting.
- We cannot be held responsible for apparent defects in the product(s) delivered.
- The defect must predate the sale and render the product unfit for its intended use.
- The provisions of this article do not prevent you from benefiting from the legal right of withdrawal set out in Article 6.
Article 10 : Liability
We make every effort to ensure the accessibility of the Site and its online sales service, and to describe the products sold as accurately as possible. However, under no circumstances shall we be held liable for any failure to perform or improper performance of all or part of the obligations for which you are responsible, or which are attributable to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure.
Hypertext links may direct you to websites other than the Site. We disclaim all liability in the event that the content of these sites contravenes the legal and regulatory provisions in force.
Article 11: Protection of personal data
Your data is intended for the CNSMDP, which is responsible for processing it. Any subcontractors working on behalf of the CNSMDP are subject to strict confidentiality and security obligations, in compliance with applicable legislation and our commitments.
In its capacity as data controller, the CNSMDP processes your data in compliance with the European Regulation n°2016/679/EU of April 27, 2016 on the protection of personal data and the French law "Informatique et Libertés" of January 6, 1978 as amended (hereinafter referred to together as the "Applicable Regulations on the Protection of Personal Data").
In accordance with the provisions of the Regulations applicable to the protection of personal data, any user of the Site has in particular a right of access, rectification, deletion of data concerning him or her and the right to obtain a copy of personal data held by the CNSMDP in a structured electronic format (portability).
Users also have the right to object, on legitimate grounds, to their personal data being processed, and the right to object to their data being used for canvassing purposes, in particular commercial canvassing.

The e-mail or letter should specify the subject of your request, your surname, first name, e-mail address and postal address (if you wish to receive a return by post), as well as any information that may help to prove your identity (customer number where possible, or a copy of a valid identity document). The copy of your ID will of course be deleted by our services as soon as identity verification has been completed.

Article 12 : Entire terms and conditions
These Terms and Conditions constitute the entire agreement between the CNSMDP and each purchaser of products offered on the Site.
If, for any reason whatsoever, any clause of these General Terms and Conditions should be declared inapplicable, it shall be deemed unwritten without invalidating these General Terms and Conditions or altering the other provisions.
Article 13 : Settlement of disputes
The General Terms and Conditions and any order placed on the Site are governed by French law, unless otherwise provided by public policy.
